1. Introduction & Definitions

1.1 These Terms of Service ("Terms") govern your purchase and use of the Dogsy & Co QR Smart Pet ID Tag ("the Tag", "the Product") sold by Cazner Pty Ltd (ABN 39 648 003 570), trading as Dogsy & Co ("we", "us", "our", "Dogsy & Co").

1.2 By purchasing, activating, or using a QR Smart Pet ID Tag, you ("you", "the Customer", "the Purchaser") acknowledge that you have read, understood, and agree to be bound by these Terms in full.

1.3 Key Definitions:

• "The Tag" — the physical pet identification tag purchased from Dogsy & Co, which includes a printed QR code.
• "QR Code" — the machine-readable code printed on the Tag that, when scanned, may direct to an online page.
• "Pet Profile" — any optional online page associated with the Tag where pet information may be displayed.
• "QR Functionality" — the digital features accessible via the QR code, including but not limited to pet profile pages, scan notifications, and location alerts.
• "The Product" — refers exclusively to the physical Tag. The QR Functionality is separate and distinct from the Product.

2. Nature of the Product — Physical Tag Only

2.4 The printed QR code on the Tag is a physical feature of the Tag at the time of manufacture. Like any printed element, it directs to a web address that may or may not remain active, accessible, or functional over time.

2.5 The primary function of the Tag is as a physical pet identification accessory. Any digital or online features associated with the QR code are ancillary, complimentary, and provided at our sole discretion.

2.6 No representation is made that any digital functionality, website, server, database, or online feature associated with the Tag will be available at any time, for any duration, or in any specific form.

3. QR Functionality — Complimentary Feature, Not a Service

3.3 Because the QR Functionality is complimentary and no fee is charged for it, no service level agreement, uptime guarantee, performance standard, or availability commitment of any kind exists.

3.4 Dogsy & Co may, at its sole and absolute discretion and without notice:

• Modify, suspend, limit, or permanently discontinue any or all QR Functionality at any time;
• Change the URL, server, platform, or technology underlying the QR Functionality;
• Remove, archive, or delete any pet profile data or associated content;
• Alter the features, appearance, or behaviour of any QR-related pages;
• Impose limits on usage, storage, bandwidth, or access;
• Require registration, authentication, or additional steps to access features;
• Transfer, migrate, or shut down servers, databases, or hosting infrastructure.

3.5 None of the above actions constitute a breach of these Terms, a breach of contract, a product defect, or grounds for any claim, refund, credit, or compensation of any kind.

4. No Guarantee of Availability or Uptime

4.2 The QR Functionality depends on third-party infrastructure including (without limitation) internet service providers, hosting platforms, email delivery services, DNS providers, mobile networks, device manufacturers, and web browsers. Dogsy & Co has no control over and accepts no responsibility for the availability, performance, or reliability of any third-party systems.

4.3 Outages, downtime, data loss, delivery failures, and service interruptions may occur at any time, for any duration, for any reason (including planned maintenance, unplanned failures, cyberattacks, natural disasters, commercial decisions, or any other cause), and Dogsy & Co bears no liability whatsoever for such events.

5. No Obligation to Maintain Data or Systems

5.2 You are solely responsible for maintaining your own records of any information you enter into the system. Dogsy & Co strongly recommends that you keep independent copies of all pet information, emergency contacts, medical details, and any other data you input.

5.3 Data deletion, loss, corruption, or unavailability — whether caused by system failure, commercial decision, third-party action, security incident, or any other cause — does not entitle you to any remedy, refund, or compensation.

6. Limitation of Liability

6.2 The QR Smart Pet ID Tag is not a pet tracking device, a GPS tracker, a safety device, a medical device, or a substitute for responsible pet ownership. It is a physical identification tag with a printed QR code.

6.3 The Tag does not guarantee the safety, recovery, or return of any pet under any circumstances. Pet owners remain solely and entirely responsible for the safety, supervision, containment, and wellbeing of their animals at all times.

6.4 In no event shall Dogsy & Co's total aggregate liability to you for any and all claims arising from or related to the Tag or any associated QR Functionality exceed the purchase price you paid for the individual Tag giving rise to the claim.

6.5 You acknowledge that the QR Functionality is complimentary, that no fee has been paid for it, and that as a free feature it is provided with no warranties, no guarantees, and no liability of any kind.

7. The Tag is Not a Safety or Tracking Device

7.1 The QR Smart Pet ID Tag is a passive identification product. It does not contain GPS, cellular, Bluetooth, RFID, NFC, or any active tracking technology.

7.2 The Tag can only function if:

• A person physically finds your pet;
• That person chooses to scan the QR code;
• That person has a compatible device with a camera and internet access;
• The website/server hosting the profile is operational at that moment;
• That person chooses to take any further action (e.g., contact you, share location).

7.3 Dogsy & Co makes no representation that any person will scan the Tag, contact you, share their location, or take any action to assist in recovering your pet. The actions of third parties are entirely outside our control.

7.4 The Tag is not a substitute for:

• Microchipping (which may be legally required in your jurisdiction);
• Council registration;
• Proper fencing, leashing, and pet containment;
• Responsible pet supervision;
• Pet insurance;
• Any other legal obligation related to pet ownership.

8. Customer Responsibilities

8.1 You are solely responsible for:

• The accuracy, completeness, and currency of all information entered into any pet profile;
• Keeping your contact details up to date;
• Maintaining independent backups of all data you enter;
• Complying with all applicable laws regarding pet ownership, identification, and registration;
• Ensuring the Tag is securely attached to your pet's collar or harness;
• Ensuring the QR code remains scannable (i.e., not excessively scratched, obscured, or damaged);
• Not relying on the Tag as your sole means of pet identification or recovery.

8.2 You must not use the Tag, QR code, or associated profile pages for any unlawful, fraudulent, misleading, defamatory, offensive, or harmful purpose.

8.3 You must not enter any information into pet profiles that is false, misleading, or that infringes any third party's rights.

9. Intellectual Property

9.1 All intellectual property rights in the Tag design, QR system, website, branding, and associated materials remain the exclusive property of Dogsy & Co.

9.2 You may not reproduce, reverse engineer, modify, or commercially exploit any aspect of the Tag's QR system, software, or associated technology.

10. Privacy & Data

10.1 Any personal information you provide (including pet details, contact information, and profile data) is handled in accordance with our Privacy Policy and applicable Australian privacy legislation.

10.2 Pet profiles are managed via a secure, passwordless login system ("magic link") sent to your registered email address. By creating a pet profile, you acknowledge and consent to the following:

• The information you enter into the pet profile (pet name, breed, photo, medical notes, owner contact details) will be publicly accessible to anyone who scans the QR code on the Tag;
• You are voluntarily making this information public for the purpose of pet identification;
• Dogsy & Co is not responsible for how any third party uses information obtained by scanning the Tag;
• You should only include information you are comfortable being publicly visible.

10.2A Medication and care reminders are a complimentary feature. Reminder emails may be sent to your registered email address based on dates you enter. Dogsy & Co does not guarantee the delivery, accuracy, or timeliness of any reminder emails and accepts no liability for missed or delayed reminders. You remain solely responsible for managing your pet's medication, vaccinations, and care schedule.

10.3 If a scanner chooses to share their location via the scan alert feature, that location data is transmitted to you (the pet owner) and is not stored permanently by Dogsy & Co.

10.4 Dogsy & Co may collect anonymised, aggregated scan data for internal analytics purposes.

11. Physical Product Warranty

11.1 The physical Tag is warranted against manufacturing defects in materials and workmanship for a period of thirty (30) days from the date of delivery.

11.2 This warranty does not cover:

• Normal wear and tear;
• Damage caused by misuse, abuse, negligence, or improper attachment;
• Damage caused by pets (chewing, scratching, etc.);
• Fading, discolouration, or wear from exposure to elements;
• Damage from chemicals, cleaning agents, or salt water;
• Any digital, online, or QR-related functionality (which is expressly excluded from any warranty).

11.3 To the extent permitted by Australian Consumer Law, all other warranties, whether express or implied (including warranties of merchantability, fitness for a particular purpose, and non-infringement), are excluded in relation to both the physical Tag and any QR Functionality.

11.4 Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

12. Refunds & Returns

12.1 Refunds and returns for the physical Tag are governed by our Returns Policy and Australian Consumer Law.

12.2 A refund may be provided if the physical Tag is defective, significantly different from its description, or fails to meet a consumer guarantee under Australian Consumer Law.

12.3 Changes to, outages of, or discontinuation of QR Functionality do not constitute a product defect and do not entitle you to a refund, as the QR Functionality is a complimentary feature, not a paid service.

13. Indemnification

13.1 To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Dogsy & Co, its owners, directors, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable legal fees) arising from or in connection with:

• Your use of the Tag or any QR Functionality;
• Any information you enter into pet profiles;
• Your breach of these Terms;
• Any claim by a third party related to information displayed on your pet profile;
• Any injury, loss, or damage related to your pet, whether or not the Tag was involved;
• Any allegation that the Tag contributed to or failed to prevent any incident involving your pet.

14. Assumption of Risk

14.1 By purchasing and using the Tag, you acknowledge and accept that:

• Pets may become lost, injured, or harmed regardless of any identification method used;
• No identification product — including microchips, GPS trackers, and QR tags — can guarantee the safe return of a pet;
• The Tag is one of many tools available for pet identification and should be used in conjunction with (not as a replacement for) other identification and safety measures;
• You assume all risk associated with pet ownership, pet safety, and pet recovery;
• You will not hold Dogsy & Co responsible for any outcome related to a lost, stolen, injured, or deceased pet.

15. Force Majeure

15.1 Dogsy & Co shall not be liable for any failure or delay in performing any obligation under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, cyberattacks, internet outages, power failures, hosting provider failures, acts of war or terrorism, labour disputes, or supply chain disruptions.

16. Modification of Terms

16.1 Dogsy & Co reserves the right to modify these Terms at any time. Updated Terms will be posted on our website. Continued use of any QR Functionality after changes are posted constitutes acceptance of the modified Terms.

16.2 If any material change to these Terms adversely affects your rights, we will make reasonable efforts to notify you via email (if you have provided one), but failure to provide such notice does not invalidate the updated Terms.

17. Governing Law & Jurisdiction

17.1 These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia.

17.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

17.3 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

18.1 These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Dogsy & Co regarding the QR Smart Pet ID Tag.

18.2 No verbal or written representation made by any Dogsy & Co employee, agent, or representative that is not contained in these Terms shall be binding upon Dogsy & Co.

18.3 Any promotional materials, marketing content, social media posts, product descriptions, or other communications are for general informational purposes only and do not form part of any contract or warranty unless expressly stated in these Terms.
